Terms of Sale
Welcome to our e‑commerce website! Below you will find the terms of service offered by our company, Dominio srl Società Benefit (“Dominio”), to visitors and customers. We want you to have a smooth shopping experience, so please read the information below carefully.
Customer Details
To process your order efficiently, you must provide all requested information at checkout, including a landline and mobile phone number. These details allow the courier to contact you and deliver your parcel without issues. Providing complete and accurate information helps avoid delivery delays.
Product Availability
We do our best to keep product availability up to date on our website, but this information is indicative. Simultaneous orders or in‑store sales may not be reflected online immediately. If there is any difference between the availability shown and the actual stock, we will inform you promptly.
Note: If an ordered item is not available or if there are significant changes to your order, we will notify you immediately. You can then decide whether to confirm or cancel the purchase.
Credit Card Payments
For your security, we do not store your credit card details. Payments are securely processed via Stripe.com, a leading global online payments platform that complies with all EU privacy and security standards. You can find more details (in English) directly on Stripe’s website.
Cancellation Fees
- If an order paid by credit card or PayPal requires a refund, we will withhold a 3% fee because payment processors do not refund it (they treat it as a non‑refundable service cost).
- You can avoid this fee by opting to receive a voucher for future use instead of a refund.
- No fees are withheld if the payment was made by bank transfer, cash on delivery, or Satispay.
Charges for Incorrect Data, Storage, Customs, and Returns to Warehouse
- The Customer guarantees that the delivery address and contact details provided are complete and correct, and that the parcel can be collected within the courier’s time limits.
- If a shipment generates additional costs or is returned to our warehouse due to reasons attributable to the Customer (including but not limited to: incorrect/incomplete address, inaccurate or unattended contact details, recipient absent, failure to collect/expired storage, refusal of the parcel, non‑payment of customs or tax charges), Dominio srl Società Benefit may:
- deduct from any refund and/or charge to the Customer all direct and documented costs incurred, including: initial and return shipping costs, storage fees, customs clearance fees and charges, duties and taxes, and any carrier/third‑party administrative fees; and
- condition any re‑shipment on advance payment of those costs and the new shipping charges.
- No charges will apply where the event is due to our responsibility, the carrier’s responsibility, or force majeure.
- This clause does not affect consumer rights regarding legal warranty and the right of withdrawal. In case of withdrawal, any return costs may be deducted only if the Customer asks us to arrange the return shipment and has been informed of such costs in advance. Upon request, we provide evidence of costs through carrier/customs documentation.
International Shipments, Duties, and Taxes
- Unless otherwise stated, shipments to non‑EU countries and/or to territories with special customs regimes (e.g., Livigno, Campione d’Italia, San Marino, Vatican City, Canary Islands, Ceuta/Melilla, etc.) are made under DAP – Delivered At Place (Incoterms 2020): duties, taxes, import VAT, customs clearance costs, and any other local charges are not included in the price or in the shipping fees paid at checkout and remain entirely at the recipient’s expense.
- Customs procedures may involve inspections and delays that are beyond our control.
- If duties/taxes are not paid or the parcel is refused, the shipment may be returned or abandoned: all resulting costs (including any non‑recoverable duties, return shipping, storage, and handling) will be borne by the Customer and may be deducted from any refund under the clause above. Duties and taxes already paid to authorities are not refundable by us.
Prices
We strive to ensure that the prices shown on the website are correct. However, errors may occur due to software issues or delayed updates. Your order is considered confirmed only when you receive our shipping confirmation. If there are price changes after your order, we will inform you and you can decide whether to confirm or cancel the purchase.
Note: We reserve the right to cancel an order and refund the amount paid in the event of pricing errors.
Right of Withdrawal (Consumers)
You have the right to withdraw from the purchase within 14 days of receiving the goods, without giving any reason. To exercise the right of withdrawal, products must be returned in perfect condition, sealed, and suitable for resale.
How to proceed:
- Tell us you wish to withdraw within 14 days of receiving the product.
- You then have a further 14 days to return the product.
- Once we receive the goods, we will refund the product price within 14 days. Shipping costs and any fees will not be refunded.
Note: Return shipping costs are at your expense. If you prefer, we can arrange collection through our courier and deduct the cost from your refund or voucher.
Important: The right of withdrawal does not apply to professional users purchasing with a VAT number.
Warranty
All products are covered by the legal warranty of conformity. Some manufacturers provide direct warranty support; in such cases, you will find the details next to the purchased product and you must contact them directly.
For products not handled directly by the manufacturer, you can send them back to us. Please include the original packaging and all packing materials. We recommend using a larger outer box to avoid damage to the original packaging.
Missing items: If any items are missing from the box you purchased, you have 5 days from receipt to check the contents. After that period we will not be able to assist if something is missing, so it is important to check immediately upon receipt.
Limitation of Liability
While we do everything possible to provide accurate and timely service, Dominio cannot be held liable for delivery delays, pricing errors, or other issues arising from circumstances beyond our control, such as strikes, adverse weather, or third‑party technical problems.
In no event shall we be liable for indirect, incidental, or consequential damages arising from the use or inability to use the products purchased on our site. Our total liability to the customer will in any case be limited to the amount paid for the products that are the subject of the claim.
Governing Law and Jurisdiction
These terms of sale and any contract concluded through our website are governed by Italian law. For any dispute concerning the interpretation, performance, or termination of these terms of sale, the competent court will be that of the consumer’s place of residence or domicile, if located within Italy. For professional customers (those purchasing with a VAT number), the competent court will be that of Dominio’s registered office.
